Terms of Service

1. Introduction

Welcome to Winify ("we," "our," or "us"). By accessing or using our website, creator studio, software, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, you must not access or use the Service.

2. The Service (SaaS & Creator Toolset Role)

Winify operates exclusively as a Software-as-a-Service (SaaS) provider and creator toolset tailored for the iGaming and content creation industries. We provide tools—including but not limited to Giveaway systems, AI Image Generators, Livestreaming integrations (e.g., Kick Bot), YouTube Sync (Videos & Clips), Discord bots, Casino Reviews functionality, Custom Websites, Rewards management, and Leaderboards (collectively, "Tools")—to allow users ("Creators" or "Hosts") to engage with their audience ("Entrants").

Important Notice regarding Liability:

Winify acts strictly as a technology provider and landing page facilitator. We are NOT the organizer, sponsor, or host of any User-Generated Campaign, Giveaway, Leaderboard, or Reward.We do not guarantee, endorse, or assume responsibility for the delivery, quality, safety, legality, or existence of any prize offered by Creators. Winify does not process bets, hold player funds, or act as an iGaming operator.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are a Creator, it is your sole responsibility to implement appropriate age-gating, KYC (Know Your Customer), or jurisdictional restrictions for your Campaigns as required by your local laws.

4. Creator (Host) Responsibilities & Indemnification

When using Winify's Tools to create or host a Campaign (e.g., Giveaways, Leaderboards, Rewards), you agree that:

  • You are solely and entirely responsible for the operation and strict compliance of your Campaign with all applicable local, national, and international laws, rules, and regulations (including but not limited to gambling regulations, advertising standards such as the UK CAP Code, and social media platform policies).
  • You will conform to the promised rules, distribute prizes to winners promptly and fairly, and resolve any disputes directly with Entrants.
  • You will not create fake, misleading, or impossible-to-win Campaigns.
  • You acknowledge that Winify provides only the software facility; any promises or obligations made in your Campaigns are binding upon you alone.

Indemnification Clause:

You agree to defend, indemnify, and hold Winify harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your Campaigns, unfulfilled rewards, regulatory breaches, or your violation of these Terms.

5. Entrant & User Acknowledgment

When participating in Campaigns hosted by Creators via the Service, you ("Entrant") agree and acknowledge that:

  • You are entering into an agreement solely with the Creator/Host, not with Winify.
  • Winify assumes zero liability for undelivered prizes, rigged leaderboards, or disputes between you and the Creator.
  • You will not use bots, scripts, or automated means to enter giveaways or manipulate results.
  • You will not create multiple accounts to gain an unfair advantage ("farming").

We reserve the right to suspend or terminate any account (Creator or Entrant) immediately if you violate these rules.

6. Intellectual Property

The Winify name, logo, design, and platform code are the intellectual property of Winify. User-generated content (Campaign text, images) remains the property of the respective user, but you grant us a license to display and promote it on the Service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY FAILURE OF A CREATOR (HOST) TO DELIVER A PRIZE OR FULFILL A REWARD.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in England.
